RTI first appeal Format

For an applicant challenging a PIO decision or absence of a timely decision.

When to Send, How It Helps & Legal Dispatch Process

1. When to Send This & How It Helps

File this statutory First Appeal when the PIO fails to respond within the mandatory 30-day window, provides false or incomplete information, or illegally rejects your RTI application. It is used to petition the First Appellate Authority (FAA) under Section 19(1) of the RTI Act, 2005 to overturn the PIO's decision and direct immediate disclosure of certified records free of cost. It is the mandatory intermediate appellate remedy required before approaching the Central Information Commission (CIC) or State Information Commission (SIC) for final penal orders.

2. Process to Send (Email, WhatsApp & Speed Post)

You may share an advance copy via email or WhatsApp for immediate notification. However, India Post Speed Post is the most valid, legally robust, and statutorily recognized form of communication of notice in India. Dispatched through India Post, it creates an official 13-digit tracking record and establishes a statutory presumption of valid service under Section 27 of the General Clauses Act, 1897 upon delivery or tender.

3. Signing & Aadhaar E-Signature Validity

The document must be signed by the sender before dispatch. While physical wet-ink signatures on printed copies remain customary, electronic signatures are legally valid under the Information Technology Act, 2000. In India, Aadhaar e-signature (OTP-based) is the most valid, secure, and statutorily recognized form of electronic signature, carrying equal legal standing to a physical signature without needing printing or scanning.
